The Federal Government says that at least one-party must be aware that the call is being recorded. This view is taken by all states except for 12. These 12 states have what is called a two-party rule. This means that all parties on the call must be aware it is being recorded.

This is usually done by having a pre-recorded message “that calls are recorded”. Most telephone systems have various methods to accomplish this. Of course, it is up to the user to determine what their individual requirements are.

Another recommendation is to make sure employees are aware they are being recorded. It is a good idea to give them time and/or a place they can make non-business calls without being recorded.
